China expects fair solution to color TV anti-dumping case

Chinanews, Apr. 4 - China's Ministry of Commerce (MOFCOM) proclaimed on
the 3rd that China expects the European Union (EU) to fairly and
reasonably handle the anti-dumping case against China's color TVs in
accordance with WTO anti-dumping rules. This is MOFCOM's first response
to the EU's resumption of imposing a 44.6% anti-dumping tax on China-made
color TVs on March 31.
In 1998, the EU levied a 44.6% anti-dumping tax on all China-made color
TVs exported to Europe and in 2002, the European Commission signed price
commitment agreements with seven Chinese enterprises including Haier and
Hisense. According to the agreements, so long as their prices were not
lower than the minimum level, color TV exports to Europe within the quota
by these seven producers could be exempted from the anti-dumping tax.
However, soon after the price commitment agreements were signed, the
seven enterprises' color TV exports to Europe were far from reaching the
total annual quota granted by the EU owing to the impacts of such factors
as lower costs of color TVs, changes in the global markets and Euro
appreciation.
As a result, the seven firms that signed the price commitment agreements
requested to cancel the price commitment. Based on the EU's anti-dumping
statute, the EU would resume imposing a 44.6% anti-dumping tax on the
seven firms like other enterprises after they have drawn back the price
commitment. Should the EU industry not request to review this case, the
above measure would expire on August 29, 2007.
Council of the European Union and the European Commission respectively
announced on Mar. 31 that they would cancel the price commitment with the
seven Chinese color TV producers and simultaneously resume imposing
anti-dumping tax.
China Business Times reported that before the announcement was published,
an MOFCOM official had stated that the EU never granted China the market
economy status and insisted China-made color TVs was involved in dumping
as it ignored the fact and practiced trade protectionism.
